The
ORDER : The Tribunal orders that the decision of the RTA to
refuse the
applicant
access to the names and
addresses of
the persons named in the
documents the subject of this application
is set aside. In substitution thereof
a decision that:;
(a) the
names of those persons on the list of attendees at the meeting
on
11 May 1999 and who are the authors of the documents at
attachment “ A” and “E” of
Mr Youngman’s statement are exempt; and;
(b) within 28
days, the applicant be granted access to the whole of the letters
dated 26 and 27 May 1999 and a copy of the list of attendees
at the meeting
on 11 May 1999 with the names of the persons
mentioned in(a) above being
deleted.

1. By notice of motion filed on 27 January 2006 and heard on 7
February 2006
the applicant seeks an interlocutory injunction in the following terms:
1 The respondent be restrained from selling the community
land at lot 107
Ocean Shores before the final determination
of the
court in the proceeding.
2 An order that the applicant’s costs of, and incidental
to this application for
interlocutory relief be borne by the
respondent. In the alternative, costs of,
and incidental to
this application for interlocutory relief to be costs in the
cause.
2. The proceeding referred to in para 1 of the notice of motion
is a class 4
application filed on 6 October 2005 in which the
applicant seeks the following
declarations and orders:
1 A declaration that Byron Shire Council under s 36 of the
Local Government Act
1993 categorise the community land at
Lot 107,
Shara Boulevarde, Ocean Shores
in DP 856767 (“Lot 107”)
as a sportsground.
2 A declaration that for Byron Shire Council to dispose of
Lot 107 pursuant to
s 45(4) of the Local Government Act would
be
a breach of statutory trust under
s 94 of the Environmental
Planning and Assessment Act 1979.
3 An order that Byron Shire Council be permanently restrained
from selling Lot 107.
4 An order that Byron Shire Council expend monetary contributions
it holds in
trust for Lot 107 within a reasonable time for
provision of sporting facilities.
5 Costs of, and incidental to this application.
